Agaba Abbas vs Mugabe in Court Over Kitagwenda Poll
A man who lost the parliamentary election in Kitagwenda has taken the matter to the High Court.Agaba Abbas Mugisha has filed a petition asking the court to cancel the results of the January 15, 2026 election in Kitagwenda County Constituency.
He claims he was the rightful winner.The petition, numbered 04 of 2026, was received and stamped at the High Court in Fort Portal on March 31, 2026. Mugisha named the winner, Mugabe Robert, and the Electoral Commission as the two respondents.
In the court papers, Mugisha says he is an adult Ugandan citizen and that he was an official candidate in the election. He describes himself as an aggrieved candidate under the Parliamentary Elections Act.
The court has also issued a notice to the respondents. It gives Mugabe Robert and the Electoral Commission 10 days to file their reply after they are served with the papers.
If they fail to respond in time, the court says it will hear the case without them.The documents were signed and sealed by the Deputy Registrar.
Mugisha is being represented by lawyers from Ocheng Associated Advocates in Kampala and Abbas Advocates in Lugogo.
The full reasons for the challenge have not been made public yet. The petition is expected to explain what Mugisha believes went wrong during the election.
This is one of the early election petitions to reach the High Court following the January polls. The case will now move forward once the papers are officially served to the respondents.
As of today, neither Mugabe Robert nor the Electoral Commission has commented on the petition.
