Bushenyi: Court grants bail to doctor accused of defiling his own daughter
Chief Magistrate Court in Bushenyi has this Tuesday granted bail to a 48 year old man who has been on remand for about 3 months over defiling his own daughter.
The director of public prosecution, Jane Frances Abodo has withdrawn the charges of aggravated defilement against the suspect identified as Gilverse Atwine, a medical doctor at St Francis Mutolere hospital in Kisoro district and preferred charges of incest.
Atwiine, a born of Isingiro whose family stays in kyamuhunga, Butare town council is said to have defiled and impregnated his 17 year old biological daughter, a S.3 student at Bweranyangi girls’ secondary school which he denied.
Atwine has been on remand at Nyamushekyera government prison since June this year when he appeared before Chief Magistrate Simon Toloko for the mention of the case but was remanded on grounds that the court had no jurisdiction to try such cases that are only triable by the high court.
Through his lawyer of Kasenene and company advocates, the suspect petitioned to DPP and the decision comes in favor of the suspect after charges of aggravated defilement were dropped and charges of incest preferred.
DPP informed the public that withdrawing the case from defilement doesn’t mean that the suspect is free against the charges.
Faith Betenga Amanya, the Bushenyi district probation officer said that as probation officer she has no objection to court’s decision but court should bear in mind that the victim needs psychological support.
Additionally, chief Magistrate Toloko granted the applicant of UGX 2 million cash bail and a non cash bail of UGX 5 million to each of the sureties.
